I have noted the testimony presented before the Madlanga Commission of Inquiry, and the matters relating to the MMC for Corporate and Shared Services, Cllr Kholofelo Morodi.
Following a formal process in which Cllr Morodi was afforded an opportunity to provide written representations in respect of the issues raised before the Commission, I have carefully considered her response together with the information available to me, including relevant communication records submitted to the Commission.
Based on this assessment, I am not satisfied that the concerns raised have been adequately addressed.
The material before me reflects a pattern of engagement and conduct over an extended period, including an inappropriate relationship between Cllr Morodi and Sergeant Nkosi, which raises serious concerns regarding the handling of information and adherence to the standards expected of members of the executive.
In particular, this includes the use of informal channels to engage on matters that fall outside formal governance and administrative processes, in a manner that is not consistent with the principles of transparency, accountability, and institutional integrity.
This decision has been taken in terms of section 60 of the Local Government:
Municipal Structures Act, which empowers the Executive Mayor to appoint members
of the Mayoral Committee and to determine their continued participation in the execution of their responsibilities.
The Mayoral Committee must, at all times, command public confidence and
demonstrate the highest standards of ethical leadership and accountability. Where uncertainty arises that may affect the integrity or effectiveness of the executive, it is necessary to act decisively in the interests of the institution.
This decision does not constitute a finding of wrongdoing, nor does it imply any presumption of guilt.
It is a measure taken to safeguard the integrity of the institution and to ensure that all processes, including those arising from the Commission,
proceed in a manner that is fair, lawful, and free from interference.
MMC Hannes Coetzee will continue to act in this portfolio to ensure continuity in the functioning of Corporate and Shared Services until such time as a replacement is appointed.
I remain committed to upholding clean governance and will continue to act in a manner that protects both the integrity of the institution and the rights of those involved.
