FORUM4SA REJECTS CONSTITUTIONAL COURT JUDGMENT, WARNS OF THREAT TO THE RULE OF LAW

By Tebogo Mashilompane

Forum for South Africa (Forum4SA) rejects the Constitutional Court’s judgment directing the Electoral Commission of South Africa (IEC) to include the specified party lists and candidate nominations in the electoral processes for the 4 November 2026 elections.

Forum4SA is deeply concerned that this judgment undermines the principles of the rule of law, fairness, accountability and equal competition in our democracy.

All political parties must be subject to the same electoral rules, deadlines and requirements.

No party should receive preferential treatment at the expense of others who complied with the prescribed electoral processes.

The fact that the Court has reserved its reasons for a later stage raises further questions about the legal basis and implications of its order.

South Africans deserve transparency and a clear explanation of how this decision upholds the constitutional principles of equality before the law and fair electoral competition.

The rule of law cannot mean one standard for some political parties and another for others.

Electoral justice must be consistent, impartial and beyond reasonable doubt.

Forum4SA calls for the full reasons for this judgment to be made public urgently.

The IEC and all relevant institutions must ensure that the electoral process remains fair, transparent and credible.

Our democracy belongs to the people of South Africa, not to any political party or institution.

Public confidence in our courts and electoral system must be protected through consistency, accountability and equal treatment under the law.
