The Forum for South Africa (FOSA) strongly condemns the conduct of National Director of Public Prosecutions, Advocate Shamila Batohi, during her appearance before the inquiry.

Advocate Batohi walked out of the inquiry proceedings and, when questioned about when she would return to answer outstanding questions, stated that she does not know.

This conduct is unacceptable and demonstrates a serious lack of respect for the commission and the public it represents.

FOSA is particularly disturbed that Advocate Batohi undermined the authority of the commission, especially considering that she herself requested the establishment of this very inquiry.

When legitimate questions were posed to her, she claimed to have no knowledge of critical issues and indicated that she would first seek legal counsel before deciding whether to return, stating that she would “let them know.”

This behaviour raises serious concerns about accountability, transparency, and leadership at the National Prosecuting Authority.

A person entrusted with leading prosecutions in South Africa cannot evade scrutiny when called to account, particularly on a matter she initiated.

FOSA believes that no one is above accountability, including the National Director of Public Prosecutions.

Walking out of an inquiry and refusing to commit to returning sets a dangerous precedent and erodes public confidence in the justice system.

FOSA therefore demands:

A public explanation from Advocate Batohi for her conduct;

A clear and immediate commitment to return to the inquiry and answer all outstanding questions;

Assurance that the authority and integrity of the commission will be respected.

South Africans deserve answers, not evasion. Accountability must apply to all, without fear or favour.
