REQUEST FOR THE AD HOC COMMITTEE ON GENERAL NHLANHLA MKHWANAZI TO INVITE MR MOOSA KUMBA FOLLOWING SERIOUS PUBLIC REVELATIONS ON POLICING AND CRIMINAL JUSTICE

1. INTRODUCTION

This submission is made in the interest of constitutional oversight, accountability, and the protection of the integrity of South Africa’s policing and criminal justice system.

It calls upon the Ad Hoc Committee on General Nhlanhla Mkhwanazi allegations to invite Mr Moosa Kumba.

Mr Kumba has made extensive and serious public revelations during his appearance
on the JJ Tabane Studio and across multiple podcast platforms.

These disclosures, now firmly in the public domain, directly implicate issues that fall squarely within the mandate of the Ad Hoc Committee currently seized with matters relating to policing conduct, leadership, and institutional accountability.

2. CONSTITUTIONAL AND LEGAL BASIS FOR PARLIAMENTARY ACTION

Section 55(2) of the Constitution of the Republic of South Africa, 1996, mandates the National Assembly to maintain oversight over all executive organs of state, including the South African Police Service (SAPS).

Section 56 further empowers Parliament and its committees to:

 Summon any person to appear before it to give evidence under oath;

 Require the production of documents;

 Receive representations from members of the public.

The Ad Hoc Committee on General Nhlanhla Mkhwanazi, having been established
by Parliament, possesses full authority to call witnesses and interrogate matters relevant to its terms of reference.

The revelations made by Mr Kumba clearly
intersect with the committee’s mandate and therefore warrant its attention.

3. SUMMARY OF THE REVELATIONS

Mr Moosa Kumba’s public statements are detailed, specific, and raise serious
concerns regarding:

 The conduct and integrity of certain policing operations and investigations;

 Allegations of selective enforcement and possible abuse of police authority;

 Potential political or institutional interference in criminal justice processes; and

 The broader implications for accountability within SAPS leadership structures.

These matters have generated significant public interest and concern and remain
largely unanswered by the relevant authorities.

4. RELEVANCE TO THE AD HOC COMMITTEE ON GENERAL NHLANHLA MKHWANAZI

The current Ad Hoc Committee on General Nhlanhla Mkhwanazi was constituted
precisely to interrogate issues of policing leadership, conduct, and accountability.

The information placed in the public domain by Mr Kumba may provide critical
context, evidence, or insight that could assist the committee in executing its mandate effectively.

Inviting Mr Kumba to testify would:

*Strengthen the committee’s fact-finding capacity;

*Ensure that Parliament considers all relevant information, including whistleblower-type disclosures; and

*Demonstrate Parliament’s commitment to transparency and comprehensive oversight.

5. OVERSIGHT CONSIDERATIONS

Parliamentary oversight is weakened when credible public revelations are ignored or treated selectively.

Allowing Mr Kumba to appear before the Ad Hoc Committee does not amount to an endorsement of his claims, nor does it interfere with judicial processes.

It simply ensures that Parliament discharges its constitutional
responsibility to interrogate matters that may point to systemic failures or abuse of power within policing institutions.

Failure to invite him would risk reinforcing perceptions that parliamentary oversight is reactive, selective, or politically constrained.

6. FORMAL REQUEST

It is therefore respectfully requested that:

1. The Portfolio Committee on Police formally refer Mr Moosa Kumba’s public
disclosures to the Ad Hoc Committee on General Nhlanhla Mkhwanazi; and

2. The Ad Hoc Committee invite Mr Moosa Kumba to appear before it to present
evidence and respond to questions under oath, in line with parliamentary rules
and procedures.

7. CONCLUSION

This submission is made in defense of constitutional democracy, institutional
integrity, and public confidence in Parliament.

The Ad Hoc Committee on General Nhlanhla Mkhwanazi presents an existing and appropriate forum to interrogate the
issues raised by Mr Moosa Kumba.

Parliament must utilize this mechanism fully and fearlessly
